Marijuana Penalties In Pennsylvania
Charges involving marijuana may lead to lengthy jail time and heavy fines. Sentencing depends on a variety of factors, including the amount of marijuana at issue and prior convictions.
Here are some common charges:
- Possession of marijuana: Possessing 30 grams or less of marijuana is a misdemeanor and carries up to 30 days in jail and/or a fine of $500.
- Possession with intent to deliver: Depending on the amount, selling or distributing marijuana is a felony that carries potential jail time of up to 10 years and a fine of up to $100,000.
- Possession of paraphernalia: This is a misdemeanor that carries a penalty of up to a year in jail as well as a $2,500 fine.
- Federal marijuana trafficking: Federal drug charges have the potential for significant penalties. A federal trafficking charge for less than 50 kilograms carries a sentence of up to five years in jail and a fine of up to $250,000. Trafficking a large amount, over 1,000 kilograms, carries a mandatory minimum penalty of 10 years. The maximum penalty is life in prison and a fine of up to $10 million.
